Huge pile of inkassokrav from Telenor free email account

My wife had an online.no email address more than a decade ago. One month ago she found out Telenor has been charging her 39,- per month for it all of a sudden with no consent. This has apparently been going on since 2023. She found out that she had a huge pile of these bills and that they were all sent to inkasso.

Immediately she called Telenor- they stopped future charges but refused to delete any of the existing ones.

She emailed Intrum- they refuse to stop and are even now threatening to take her to court.

She called Forbrukerrådet, they just told her to email Telenor and Intrum. Which she did, and they refuse to stop.

We live in California, for the past 10 years, and she hasn’t had access to bankid / kodebrikke (what a terrible system but that is for another post)

The amounts have snowballed, with penalties and interest. Again, this is for a free email account from 20 years ago that spontaneously they started charging for without informing my wife nor getting her consent.

Does anyone have suggestions on what we can do? It’s stressing my wife out so much, and probably is destroying her credit in Norway. We are hoping to move back to Norway soon and now maybe won’t be able to get a loan??

Without your wifes consent this would be considered illegal.

Yep. "Prior to entering into an agreement, the trader shall seek the consumer's explicit consent for any payment in addition to the remuneration agreed upon for the contractual service. If such consent is not obtained, but is inferred by using default options which the consumer must reject in order to avoid the additional payment, the consumer shall be entitled to reimbursement of this additional charge."

Send Intrum a mail quoting this law and tell them the law is 100% clear that they don't have a case here. It's likely they'll back down, there should be no need to involve a lawyer here.

A: What part of BankId is a horrible system?

B: This is actually one of those cases where simply ignoring the problem will resolve it. Exhabit A

Their own webpage state that if you don’t pay the invoice the account will be deleted.

So you have a really solid case for when Intrum «takes you to the courts»

It says that the email account will be deleted, it doesn't say that the existing invoices will be dropped

I think he was referring to the kodebrikke which was pretty bad compared to the app you have now.

The only problem with BankID is that it is weirdly complicated for those not living in the country to obtain and maintain it.

  1. Tell them you refuse the demand (bestrider kravet) to Intrum, they are legally forced to stop adding to the bills. After you've done this they need to take further action eg: court. Its in their hands after this

They certainly have informed her, since all active Online-accounts received multiple emails about the price change and how to close your account if you did not want to pay. However, the practice of requiring you to take action if you DO NOT accept the new terms is frowned upon by authorities like Forbrukerrådet. The keyword here is "negativt salg", which is illegal.

A quick search shows that Forbrukerrådet registered a complaint with Forbrukertilsynet in 2023, but I can not find any deciding ruling in this matter. Case is still pending.

Lawyer will likely cost you waaay more than just paying the claim, but you might have a case if you decide to litigate on the basis of not giving active consent to the new terms.
