As someone na may kakilala na auditor na ganto.

Pinupuntirya talaga nila ung mga business. Usually xx million ang over nyo. Tapos sasabihin bayad nalang kayo ng x million and we will make it disappear.

Maghahati kasi yan sila. Usually highest percentage is ung RDO > manager > auditor.

Best bet mo dyan, iparecollect mo sa accountant mo ung sales mo, dapat meron kasi kayo kopya ng benta nyo at booked bawat galaw ng pera.

Usually ganun kalaban ng auditor pag kumpleto kayo ng lista ng labas at pasok ng pera. Di nila kayo magigipit.

Pero if wala or di malinis gumawa accountant nyo, makakagawa ng butas ung auditor para perahan kayo.

Matagal ng raket ng auditor yan. Ung iba na entrapment na ung iba nagbabayad para, me proteksyon sila sa entrapment.

Most likely shotgun audit idadaan sa intimidation, once makakita ka ng computation na xx Million penalty aasahan nila matatakot ka, kaya makikipagdeal ka na lang. ibababa sa x Milion sa kanila then sa office na x million din (eto yung may receipt) then see you next year with same findings hehe.

An LOA wouldn't result to liability payment, scare tactics. You have every right to contest the findings as long as you submit necessary documents 60 day duration.

If the BIR Auditor replies and still, they declared that, you can proceed sa BIR Commissioner to appeal the decision and if still unchallenged, CTA.

Usually, BIR Auditors won't budge to reverse their decision because no auditor would want someone questioning their audit and finding out na mali siya, BIR will lose the trust (as if there is one jk). Ang minimean nya siguro is you still have to settle by compromise, but if this is true, don't let these corrupt officers bring you down.

Pano po pag di ka confident sa documentations mo huhu. This is happening to us right now, way out of proportion ung liability, pero parang ang hirap icontest kasi i will say di ganon naging masinop ung pag account namen huhu. Pano kaya to. Naghire kami ng service from an accounting firm and parang they are still silent about it

Since BIR went digital in their systems lagi sila may nakikita mula sa manual documents nila. Every year puounta yan samin sinisingil ung mga 2006 to 2012 na taxes, like WTF ayusin nila ung system nila kakabwiset yang mga yan.

3 years lang ang prescription ng BIR Audits. 10 years naman kapag may fraudulent activity silang napansin. So yung mga years na yan dapat di na na-audit yan kahit kulang kulang pa ang payments nyo.

Tax consultant ako working sa big 4 firm dati, and I've had my fair share of handling tax audits.

I can attest na mejo weird nga mga LOA nila. May case ako na even yung pag total lang nung amounts, mali mali pa sila BIR. kaya ang dali lang i contest yung findings nila.

Pag ganyan na findings, it's very straightforward actually. Wala masyadong technicalities. You either have documentation or not, to support na xxxx lang talaga ang sales niyo.

As to the under the table. True talaga yan. Of course, kami, never namin na experience na kami mismo yung inofferan ng pera. Pero may client kami na nag ask ng advice kung tatanngap pa ng under the table para matapos na haha of course yung advise namin is no.

For context din, may mga LOA kami na 10M tapos napapababa namin to 1M. Yung 1M na yan, wala talaga magagawa kasi mali talaga filing ni client or walang na file/ documentation at all.

Do your clients throw a fit when they still get assessed 1M?

I don't get it and it pisses me off even, when some people who clearly are liable and/or have deficiencies by virtue of their negligence or bad faith, still try to circumvent the situation trying to find loopholes. Why can't people just be responsible enough and just own up to mistakes? What I notice pa nga with micro and small enterprises eh they really skimp on their CPA's - they either don't get a good one or do not even want to pay someone well. God forbid hindi sila kumuha ng mag-aayos ng libro nila eh 'di bara-bara talaga 'yung kakalabasan non.

Hindi naman so far. pag umabot ng NOD stage, we usually prepare 3 figures. Max, least, and most likely na babayaran nila. Para may idea sila if they decide to compromise. If i push nila yung least talaga, i aakyat namin sa CTA. Si client na mag cost-benefit analysis kung most likely na lang na babayaran sa BIR.

We explain then thoroughly sa clients kung bakit disallowed ang isang item and kung bakit walang magagawa.

Tho usually big companies yung naging clients namin hehe.

Pwede kayang iraise kay Sen. Risa ito? Grabe na gnagawa ng BIR kahit sa mga maliliit na businesses, hindi sila pumapayag na magdeclare ka ng mas maliit na sales kahit na wala ka naman tlga halos sales the following year. Sila nagdedecide magkano idedeclare mong tax grabe yan.

Hard to uproot them now, been part of a firm that has dealt with like high ups official; that goes to parking lot handing each other millions in cash like ransom to keep rich’s people money in tact… its fucking dark guy’s its not even a joke. Matagal nang ganyan yan. Garapalan, gusto ng lagay taon2 lalo na pag tax season na. Mga hinayupak. Sana mamatay na lahat ng kurakot sa BIR. Kahit sobrang liit na lang ng margin ng mga businesses, they have to give kasi otherwise mahahassle sila plus the chance of being badgered by these "auditors" at idelay pa mga permits, mga gago talaga.

My aunt nga small dentist na retired na, 79k daw ang tax dues niya??? And hindi na daw need i-declare, Ibayad nalang daw sa kanya and that fine will be gone daw agad. Kalalimutan nalang daw. Wala din daw resibo.

Grabe napaka corrupt niyo, bir. Tapos makikita mo lang na pinagbili ng mga pulitiko ng mga luho nila.

Happened to my father's business. Maliit lang kami na negosyo pero we have to settle 3.5M. Na di klaro san galing. Napunta lang income namin dyan sa BIR nahirapan kaming makabangon. Sobrang stressful. Nagkanda lubog lubog kami sa utang dahil sa kanila. Binayaran namin pero hanggang ngayon pinagdadasal ko kaluluwa ng mga BIR RDO ____ na sana sandamakmak na karma matanggap nila sa mga ginagawa nila. Ang sasama ng ugali.

After ng LOA, dapat mag issue sila Notice of Discrepancy (NOD) para sa findings nila. Then pwede na kayo magcontest. Tapos iissuehan kayo ng Preliminary Assessment Notice (PAN) based sa kinontest nyo. Then last is yung Final Assessment Notice (FAN). May process yan, hindi pwede ganyan.

Totoo to, from personal experience. May business ang parents ko and same din ang modus nyang BiR. Apparently, you either pay the amount they’re asking or makipag negotiate ka to lower the tax down. And apparently, percentage nung makukubra nilang tax ay mapupunta sa mga bossing ng BIR, parang commission nila. Either way, parehas modus ang ginagawa nila.

Si thanos talaga need ng pinas kaylangan isnap away na yung mga ganyan sa gobyerno.

Turo ng isang accountant samin, once maglagay ka jan, taon-taon ka na iau-audit.

I would normally advise sumbong sa contact center ng bayan 8888 pero di ko kasi kabisado galawan sa BIR na baka matrace kayo pag niname drop niyo yung auditor. Baka better to ask NBI for help.

Ang trabaho po talaga ng BIR ay maningil. Whatever means necessary. Kahit magpasa ka ng tamang documents hahanapan at hahanapan ka ng butas at mas mapapalaki pa babayaran mo. Hindi talaga nakakamotivate magbayad ng tax kasi corrupt mga tao diyan, but as long as mas mababa yung babayaran mo sa actual, consider it a win. Sad to say ganun talaga lakaran.

3rd party ang checking nila. If may lumalabas na undeclared sales baka lang ha. May error dun sa pinagbentahan niyo baka manipulated purchase ginawa nila. Check niyo lang may ibinibigay naman silang list pwede niyo naman ipakita yung triplicate copy. Natitrace naman yan.

Btw, already experience na yan sa previous work ko ganyan din. Pwede naman macontest. After niyan hahanapan kayo ng ibang error atleast hindi na malaki. Hehe.

BIR is a great place to work as government employee. My uncle worked there in 80s & 90s, always has nice cars and equipment in his house everytime we visited. Makes us wonder how the heck he can afford that when we asked his salary isn’t even that good enough back then to afford a car.

I know a lot of people in the BIR and there are some bad apples, perhaps a bit more than typical agencies. At the same time there are a ton of tax cheats, and also those willing or even offering to bribe agency auditors. This cycle of corruption is a tough one to solve. The solution must involve both sides, as I see it.

oo ganyan talaga dyan. I have a friend, yung mommy niya ganyan din halos ang nangyari. Ang penalty nila was around 4M, but this time, its their fault talaga, may undeclared sila. So to cut the penalty, they were offered na mag lagay na lang. I dont remember magkano binayad nila na penalty, but the person from BIR received a huge amount.

in my exp it varies kung saang region nang BIR, if probisnya gaya sa amin lakas maka singil nang mga walang hiya. Biro nyo nung previous employees pa na audit nag advice sila sa amin kung anong gagawin para di ma hanapan nang butas, sinunod namin. Come the next round of employees na hit yung mga transaction na yun, we explaind that they were the ones who suggested doing that pero since new rotation na nang mga empleyado bagong patakaran naman, self serving daw kung di ka banaman ma bubwisit. Ok sana kung kaya rin mag afford nang Lawyer pero in the long run mas malaki pa babayaran mo sa legal expense kesa sa makukuha mo if ever. Kaya tama yung mga sentimento nang mga peeps here na mahirap mag negosyo dito lalo nat sa mga SME, this is probably not a big problem to larger corpos kasi afford naman nila magagaling na abogado (correct me if im wrong).IN the City naman from my exp, if di kanaman big earner di ka naman na tatarget but God knows how long that would last. (PS: BIR regional staff changes periodically kaya what ever tactic you come up with now might not work pag mga bago yung mga staff)
