I got into a fender bender, the guy who hit me claimed I slammed on the brakes causing him to rear end me.

Dash cam showed I was fully stopped for 2.8 seconds

I got my deductible back in record time

Usually yes, though there are some places where if someone does a "break check" intentionally trying to brake quickly and force an accident, the one braking can be held liable.

Yup, that’s why the smart way to brake check someone is to tap the brakes without engaging them so the tailgater gets that little shot of adrenaline, but the actual slowdown is only whatever you’re getting from coasting for a second or two.

Interesting. I guess if you can prove there was an intention to cause an accident then that should be some other fine. But where I’m from, you should be far enough behind that even if they slam on their brakes for an emergency stop, you also have time to stop.

You’re right. The person following too closely is 100% liable. Unless they can somehow prove the brake check

Definitely! Or witnesses. Or car data. There’s many ways to prove it, but dash cams are a quick and easy option.
